RaboDirect's Internet services are subject to the European directives on electronic trading and to applicable Irish law. All intellectual property rights related to this website www.rabodirect.ie, its content, its data and its form, as well as to the information, brand-names, trademarks, logos and images on this website, belong to one or more of the Rabobank group companies and/or to third parties who have granted a right of use or other right to RaboDirect or members of the Rabobank group. On no account shall access by you to this website constitute the transfer of any intellectual property rights to you. As a result, you are prohibited from copying, using or selling in any way whatsoever any part or all of this website and the documentation and information on it. You do have a limited right to print a hard copy the consents of this website but, if you do so, all intellectual property and other proprietary notices must be retained un-amended.

How you can become a customer

Access to this website and to the information on it does not constitute an offer to enter into a contract, nor does it constitute an offer to buy or sell RaboDirect's products. A contractual relationship between you and RaboDirect shall only come into effect when all of the following conditions have been complied with:

1. You send RaboDirect a properly completed and signed application form in relation to the account that you wish to open.

2. After receipt, checking and acceptance of the application form, RaboDirect will send you, by return post, the electronic device (known as a Digipass) that you will need to operate your accounts online.

3. You, as the customer, have accepted the Terms and Conditions expressed to apply to the product or service which you wish to use.
            
RaboDirect is legally obliged to verify the identity of our new customers. You will be obliged to provide RaboDirect with all information, including any corroborative documents that we may request, that RaboDirect deems necessary to comply with its legal and regulatory obligations. If you are unable to provide adequate information to validate your identity, RaboDirect will not be able to accept you as a customer. You warrant that any such information that you provide to RaboDirect is true, correct and up-to-date in all respects. RaboDirect reserves the right to reject any application received, without having to provide a reason for such rejection.
 
Who can become a customer?

Accounts such as the RaboDirect Current Account, the RaboDirect Savings Account, the RaboDirect Investments Account and the RaboDirect Credit Account are solely intended for natural persons who are permanent residents of the Republic of Ireland. The RaboDirect Business Savings Account is solely intended for sole traders, partnerships and private limited companies which are resident, for legal and tax purposes, in the Republic of Ireland.
 
US Citizens

Unfortunately, for legal reasons, RaboDirect cannot at this time facilitate the opening of accounts for residents of Ireland who are US citizens.
 
Rates

The rates applicable to the different RaboDirect products and services are published on this website in the sections containing more specific information on those products and services. These rates are also published in the 'rate overview' section. You will be informed, in a timely way, about any changes to our rates, unless the you entered into an agreement with RaboDirect to which a specific rate applied for a specific period, and that specific period ends, at which time the new rate will be that as detailed (or in respect of which the manner of calculation thereof was detailed) in your original agreement with RaboDirect. 
 

Deposit Guarantee Scheme & Investor Compensation Scheme?

Rabobank is a member of (a) the Dutch Deposit Guarantee System and (b) the Dutch Investor Compensation Scheme, implemented by the Financial Supervision Act 2007 and related decrees. Broadly speaking, the Dutch Deposit Guarantee System deals with money - deposits in current and savings accounts - while the Dutch Investor Compensation Scheme is about securities held on your behalf by Rabobank. The Deposit Guarantee System and the Investor Protection Scheme will only become applicable if Rabobank enters into bankruptcy proceedings. However, Rabobank is a AAA-rated bank and consistently maintains these ratings. This is the highest level of creditworthiness that a bank can have. RaboDirect is the brand name of the internet bank that is part of Rabobank's Dublin branch. Accordingly RaboDirect has full AAA status.

(a) Dutch Deposit Guarantee System

The Dutch Deposit Guarantee System guarantees the interests of account holders, and applies to deposits in current and savings accounts.  Under the Deposit Guarantee Scheme, if Rabobank is unable to meet its obligations to repay a customer's balance, the customer is guaranteed to be repaid 100% of the first €100,000 of his balance. In the case of a joint account, the maximum amount of €100,000 set out above applies to each joint account holder.

(b) Dutch Investor Compensation Scheme

As a supervised Dutch bank, Rabobank is required to safeguard your securities and other financial instruments. This means that your securities are separated from the assets of the bank. Even if Rabobank goes out of business, you remain fully entitled to your assets. Practically speaking, you have in that case to instruct Rabobank to transfer your assets to another broker or bank. In the unlikely event that your assets are not identifiable anymore and have become part of the bankruptcy estate, the Dutch Investor Compensation Scheme may become applicable. If Rabobank is unable to meet its obligations to repay a customer's balance, the customer is guaranteed to be repaid 100% of the first €20,000 of his balance.

(c) Procedure

If Rabobank goes out of business, the Dutch Central Bank ('DCB') will start the compensation process. Certain information is available on the website of the DCB (www.dnb.nl) in relation to the Deposit Guarantee Scheme and the Investor Compensation Scheme. Parts of this site are also accessible in the English language.

(d) Which RaboDirect customers may benefit from the Deposit Guarantee Scheme and the Investor Compensation Scheme?

Subject to very limited exceptions, in the unlikely event that Rabobank enters bankruptcy proceedings, the following types of RaboDirect customers may benefit from the Deposit Guarantee Scheme and the Investor Compensation Scheme:

(i) personal customers;
(ii) sole traders;
(iii) partnerships;
(iv) companies who satisfy at least two of the following conditions:

(A) a balance sheet total that does not exceed €2,500,000 per year;
(B) a net turnover not exceeding €5,000,000 per year; and
(C) a workforce not exceeding 50 people in the financial year.

Store your security code somewhere safe and keep it secret, as you are solely responsible for maintaining its confidentiality. You agree not to transfer or sell your use of, or access to, any accounts or services that we agree to provide to you to any third party. You agree to immediately notify us of any unauthorised use of your Digipass, security code or other verification information, and any other breach of security. In addition, you should visit this website regularly to keep up to date with any changes.

Queries and Complaints

Your views are genuinely important to us at RaboDirect. We encourage feedback from our customers - the good and the bad. If you have a complaint we would like the opportunity to put things right as quickly as we can. So, where do you send your complaint ?

If you telephone us with your complaint, we will treat your complaint as if it was sent by you in writing. We will acknowledge your complaint within five working days, and let you know who is looking after your complaint, their contact details and how soon we hope to have your complaint resolved. We will investigate your complaint in full and seek to resolve it promptly and fairly within 2 weeks where possible. Some complaints can be resolved much sooner, others may take more time to fully investigate. If we cannot resolve your complaint within 40 working days, we will advise you of when we expect to resolve it. If you are not satisfied with this, you are entitled to refer the matter to the Financial Services Ombudsman's Bureau, 3rd Floor Lincoln House, Lincoln Place, Dublin 2 (www.financialombudsman.ie).

We will keep you informed during the process on a weekly basis. We will issue you a formal response outlining the findings of our investigation and the appropriate action we can take to address your complaint. If you are not satisfied with our handling of the complaint or with the outcome of our investigation, we would hope that you would let us know immediately. We will always do our very best to satisfy our customers but if you feel we have failed to do so, you are entitled to refer the matter to the:
